Those Pesky Disclaimers

They are rather short and are usually hard to see…. and there lies the problem.  By law, disclaimers need to be “clear and conspicuous” to help protect you from legal problems.

A Florida pizza chain felt the bite of some NYC attorneys who said their disclaimers were too small and very hard to see on their website. In a prior settlement, the pizza chain was supposed to use obvious and clear disclaimers on their website, menus and boxes because they were using an NYPD (shield logo) for advertising purposes.
